Principles for Handling and Protecting Personal Data
1. BASIC INFORMATION
1.1 We are business entities Mighty Impacts s.r.o., Bitters s.r.o., and Bitters Energy a.s. (hereinafter referred to as “Companies”), with registered addresses at Pod areálem 406/16, Prague 10, ZIP Code: 102 00, ID Numbers: 24299171, 04141997, and 06349595 respectively, registered in the Commercial Register maintained by the Municipal Court in Prague, registration numbers C 194408, C 242945, and B 22749. In accordance with the General Data Protection Regulation (Regulation (EU) 2016/679), the Companies are joint controllers of your personal data, meaning we collect, store, and use (process) your personal data for the purpose of conducting our business activities (the specific purposes for which personal data is processed are further defined below).
1.2 The Companies treat all processed personal data as strictly confidential and handle it in accordance with applicable data protection laws. The security of your personal data is a priority for the Companies.
2. TYPES OF PERSONAL DATA WE PROCESS
2.1 We process only the personal data that you provide to us when using our Online Shop at the website addresses www.bitters.cz or www.bittersgum.com, or by any other means you choose.
2.2 When visiting our website, we may also collect certain information about you, such as your IP address, date and time of access to our website, information about your internet browser, operating system, or language settings. We may also process information about your behavior on our websites, such as which links on our websites you visit and which products are displayed to you. However, for the sake of your privacy, information about your online behavior is anonymized, and therefore we cannot associate it with a specific user, i.e., a specific person.
2.3 If you access our websites from a mobile phone or similar device, we may also process information about your mobile device (data about your mobile phone).
2.4 We also automatically process cookies.
3. WHY WE COLLECT AND PROCESS YOUR PERSONAL DATA
3.1 We process your personal data for the following purposes:
- Purchase of goods and services: Primarily, we process your personal data to properly process and deliver your order. If any problems arise, your personal data allows us to know who to contact.
- Customer care: If you contact us with any questions/issues, we need to process your data to answer/resolve them. In some cases, personal data may also be transferred to third parties (e.g., carriers of goods).
- User account: If you have created a user account with us, we may provide you with access to various useful features based on the personal data you provide in your user profile (e.g., if you provide your phone number, we can easily inform you when your order will be delivered). You can change the data you entered at any time, except for the email address used to access your user account.
- Marketing activities:
- Email marketing: We send commercial emails only with your consent. You can easily unsubscribe from receiving commercial emails by contacting us on our hotline at +420 774251159 or by emailing us at info@bitters.bio.
- Marketing contests: In some cases, the winner of a contest may be photographed or recorded, mainly to increase the transparency of our marketing contests. We perform this processing of personal data based on our legitimate interest, which consists of increasing the credibility of marketing contests in the eyes of other participants and enhancing the attractiveness of these contests. You may object to this processing.
- Customer reviews of goods and services: After making a purchase of goods or services from us, you may be asked to provide feedback. You can also submit reviews on your own initiative.
- Assertion of rights and legal claims and control by public authorities: We may also process your personal data to assert our rights and legal claims (e.g., if you have an outstanding debt owed to us). Furthermore, we may process your personal data for the purposes of inspections carried out by public authorities and for other similarly serious reasons.
4. LEGAL BASIS FOR PROCESSING PERSONAL DATA
4.1 Contractual performance and conclusion – We need a significant portion of your personal data to be able to conclude a purchase or other agreement regarding goods or services you want to purchase from us. Once the contract is concluded, we process your personal data to properly deliver the purchased goods, or to properly provide the purchased services. Based on this legal basis, we primarily process billing and delivery data.
4.2 Legitimate interests – We use your personal data to provide you with relevant content, i.e., content that is interesting to you. Based on legitimate interests, we process, in particular, personal data that we process automatically and cookies. For the same legal reason, we may send you email and SMS messages as our customers. If we process your personal data on this legal basis, you may object to such processing.
4.3 Consent – For the purpose of sending commercial communications, we process your personal data based on your consent. If you do not give us your consent and you are our customer, we may send you commercial communications without your consent. In any case, you can easily prohibit such marketing communication from us by contacting us by phone at +420 774251159 or by emailing us at info@bitters.bio. If you give us your consent to process personal data, you can revoke it at any time.
Transferring Personal Data to Third Parties
We may transfer your personal data to third parties only in the following cases:
Goods Delivery: Your chosen carrier wouldn’t be able to deliver the ordered goods if we didn’t provide them with details about where and to whom the goods should be delivered. We transfer this information to the carrier based on the details you provide in the order. These transferred data primarily include your name, address for delivery, telephone number for carrier contact, and, if the goods were not prepaid, the amount to be paid upon delivery. The carrier is authorized to process the personal data we provide them with only for the purpose of delivering the goods and must promptly delete the personal data thereafter.
Goods Storage and Delivery by Contractual Partners: If you order goods from us that are stored in the warehouse of our contractual partner, we must transfer your personal data to this contractual partner to fulfill the order. The transferred data include your name, delivery address, telephone number for carrier contact, and, if the goods were not prepaid, the amount to be paid upon delivery. This contractual partner must then provide the specified personal data to the carrier who will deliver the goods, as otherwise, the carrier would not be able to deliver the goods to you. Both the contractual partner storing goods for us and the carrier are obliged to use this personal data only for the purposes of storage/delivery of goods and to promptly delete them thereafter.
Payment Cards: Our company does not have data about the payment cards you use with us. Only the secure payment gateway and the respective banking institution have access to your payment card details.
Commercial Communications: In the case of sending commercial communications (e.g., by email or SMS) or telemarketing, we may use a third-party entity for distribution or telephone calls. This entity is bound by confidentiality obligations and may not use your personal data for any other purpose.
Heureka: We assess your satisfaction with purchases through email questionnaires as part of the Verified by Customers program, in which our e-shop participates. We send these to you every time you make a purchase unless you reject their sending in accordance with § 7 para. 3 of Act No. 480/2004 Coll., on certain information society services. We process personal data for the purpose of sending questionnaires in the Verified by Customers program based on our legitimate interest, which is to assess your satisfaction with purchases from us. For sending questionnaires, evaluating your feedback, and analyzing our market position, we use a processor, the operator of the Heureka.cz portal, to whom we may provide information about purchased goods and your email address for these purposes. Your personal data is not passed on to any third party for their own purposes when sending email questionnaires. You can object to receiving email questionnaires in the Verified by Customers program at any time by refusing further questionnaires using the link in the questionnaire email. In the event of your objection, we will no longer send you questionnaires.
Government Authorities: In the event of enforcing our rights, your personal data may be transferred to a third party (e.g., a lawyer). If the law or a government authority (e.g., the Czech Police) imposes an obligation on us to provide your personal data, we must do so.
